Terms and conditions

Applicability

For all orders via our online store, the following terms and conditions apply. Our online store focuses on consumers only. A consumer is any natural person who concludes a legal transaction for purposes to which neither their commercial nor their independent professional activity can be predominantly attributed. An entrepreneur is a natural or legal person or a legal partnership which acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

Orders

Orders are taken by confirmation or their fulfillment. I place orders in accordance with your general terms and conditions.

Individually designed goods

(1) You provide us with relevant information, texts or photographs necessary for the individual design of the work of art via e-mail immediately after the conclusion of the contract.

(2) You undertake not to transmit data whose content violates the rights of third parties (especially copyright, naming rights, trademark rights) or violates the existing laws. You indemnify us against all third-party claims listed in this context. This also applies to the costs of legal representation required in this context.

(3) We do not check the accuracy of the transmitted data and do not take any responsibility for errors.

Deliveries

Since we create unique works of art, deliveries take between 15 and 30 days. If possible, delivery periods are specified in the order confirmation. In cases of special orders and in special cases, deliveries may be delayed; we will try to inform you immediately.

Deliveries are free of charge in Germany. For deliveries to other countries, contact us before ordering so we can estimate the delivery costs and make individual arrangements. We do not deliver to packing stations. The buyer can take over the goods. Contact us via phone or e-mail.

Payment

The following payment methods are available in our online store:

Prepayment – if you choose this payment method, we will give you our bank data in the order confirmation and deliver the goods upon payment receipt.

PayPal – in order to be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction.

Cash payment upon collection at our address – you pay the invoice amount in cash upon collection.

Retention of title

The seller reserves the right to ownership until full payment.

Excluding liability

(1) Claims for compensation for damage by the buyer are excluded, unless otherwise stated below. This also applies to legal representatives and deputy representatives of the service provider, provided that the customer files claim against them.

(2) Liability exclusion referred to in paragraph 1 does not include claims for compensation for damage in the event of injury to life, limb or health or in the event of a breach of basic contractual obligations. Basic contractual obligations are those whose fulfillment is necessary to achieve the goal of the contract. The liability exclusion also refers to damage caused by intentional or gross negligence and breach of duty by the provider, his legal representatives or assistants.

Transport damages

If goods are delivered with obvious transport damage, please report such errors to the deliverer

and contact us immediately. Failure to make a complaint or contact us will not have any consequences for your legal claims and warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.

If the value of the goods is higher, we recommend insurance or personal collection.

Return of goods

In case of complaint, the buyer is entitled to a refund within 30 days of the receipt of the goods. The buyer pays the costs. Payment already made for the goods will be refunded after we receive the goods.

Place of performance / Place of jurisdiction

The law of the Federal Republic of Germany shall apply exclusively to the exclusion of law provisions on the international purchase of movable goods and on the conclusion of international agreements on the sale of movable goods. The place of performance is Frankfurt.
